Puckett, hereinafter referred to as the defendant, was charged by information in the county court of Garfield County with the crime of operating a motor vehicle while under the influence of intoxicating liquor. Defendant was tried before a jury who returned a verdict of guilty and left the punishment to be assessed by the trial judge who sentenced defendant to serve 30 days in the county jail and to pay a fine in the amount of $200 and costs of the action.
